We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
You retain full ownership of all journal entries and content you create within Dear My Past ("Your Content"). We do not claim any intellectual property rights over Your Content.
By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, process, and display Your Content solely for the purpose of providing the Service to you. This licence ends when you delete your content or close your account.
We will never use the content of your journal entries for advertising, model training, or any purpose other than providing the Service to you.
Dear My Past offers AI-powered features that generate reflections and responses based on your journal entries. You acknowledge that:
The AI Reflect feature is designed as a personal journaling companion. To ensure fair and reliable access for all users, the following limits apply:
Per-Entry Limit
Each journal entry may receive a maximum of 3 AI reflections. Once the limit is reached for a given entry, no further reflections can be generated for that entry. This limit applies regardless of your subscription plan.
Usage Rate Limits
To protect the Service from abuse, automated rate limits are applied at the API level. Attempting to circumvent these limits — for example by using automated scripts, bots, or exploiting technical means to exceed plan allowances — is a violation of these Terms and may result in immediate account suspension.
Higher Usage Needs
If you require higher AI usage than your current plan provides, please consider upgrading to the Premium Plan, which offers expanded AI access. We do not offer one-time credit top-ups outside of a subscription upgrade.
Service Integrity
We reserve the right to adjust AI usage limits at any time in order to maintain service quality and fairness for all users. Material changes to limits will be communicated with reasonable notice as described in Section 15.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
All content, design, graphics, logos, and software that make up Dear My Past (excluding Your Content) are owned by or licensed to us and are protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written permission.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for any loss of data due to technical failures.
We strongly recommend that you maintain your own backups of important journal entries.
To the fullest extent permitted by applicable law, Dear My Past and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, revenue, or goodwill — arising from your use of or inability to use the Service.
Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $10.00 USD if you have not made any payments.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, the above limitations apply to the maximum extent permitted by law.
You may close your account at any time by contacting us at dmpofficial@dearmypast.com. Upon account deletion, your journal entries and personal data will be permanently removed within 30 days.
We may suspend or terminate your account at any time if you violate these Terms, with or without notice. Upon termination, your right to use the Service will immediately cease.
These Terms shall be governed by and construed in accordance with applicable law. For users in the European Union, mandatory consumer protection laws of your country of residence shall apply.
Any disputes arising from these Terms shall be resolved through good-faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration or the courts of the applicable jurisdiction.
We reserve the right to update these Terms at any time. When we make material changes, we will notify you by email or through a prominent notice in the app at least 14 days before the changes take effect.
Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.
